Welcome to Zovi Food. These Terms & Conditions ("Terms") govern your access to and use of the Zovi Food website, mobile application, and related services.
By accessing or using Zovi Food, you agree to these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. About Zovi FoodZovi Food is an online food ordering platform that allows customers to discover restaurants, food businesses, food products and place orders through the platform.
Depending on the service, Zovi Food may act as a technology/intermediary platform connecting customers with restaurants, food businesses, delivery partners and other service providers.
2. EligibilityYou must provide accurate information while creating an account or placing an order.
By using Zovi Food, you confirm that:
You are legally capable of entering into a contract.
The information provided by you is accurate and complete.
You will use the platform only for lawful purposes.
You will not misuse, damage, disrupt or attempt to gain unauthorized access to the platform.
Some features may require you to create an account.
You are responsible for:
Maintaining the confidentiality of your account information.
Keeping your login credentials secure.
All activities performed through your account.
Providing accurate contact and delivery information.
Zovi Food may suspend or terminate an account if fraudulent, abusive or unlawful activity is detected.
4. Food Products and Restaurant InformationRestaurants and food businesses listed on Zovi Food are responsible for the preparation, quality, ingredients, packaging and legality of the food they supply.
Food descriptions, prices, photographs, availability and other information may be provided by the respective restaurant or food business.
Zovi Food may display such information on the platform for customers.
Food businesses using the platform must comply with applicable food-safety and licensing requirements. Zovi Food may require applicable FSSAI registration/license information from food businesses where required by law.
5. Food Allergies and Dietary RequirementsCustomers are responsible for reviewing available food information and informing the restaurant about allergies or dietary requirements where the platform provides an option to do so.
Zovi Food does not guarantee that food will be completely free from a particular allergen or ingredient unless expressly stated by the food business.
Customers with serious allergies should contact the restaurant directly before ordering.
6. Placing an OrderWhen you place an order through Zovi Food:
You select the food items.
You provide the required delivery information.
You select an available payment method.
You confirm the order.
The restaurant or food business receives the order for processing.
An order is subject to acceptance and availability.
Zovi Food or the restaurant may cancel an order when an item is unavailable, the restaurant is unable to fulfil the order, delivery is not possible, payment fails, or another legitimate operational issue occurs.
7. Prices and TaxesPrices displayed on Zovi Food may be provided by restaurants or food businesses.
Applicable taxes, packaging charges, delivery charges, platform/service charges or other applicable fees may be displayed separately before order confirmation.
The final amount payable will be shown during checkout.
Prices and charges may change without prior notice, but changes will not affect an order that has already been confirmed unless required by law or agreed with the customer.
8. PaymentsZovi Food may provide multiple payment methods, including online payment and other methods available at checkout.
Payments may be processed through third-party payment service providers.
Zovi Food does not store complete payment-card information unless permitted and required under applicable law and security standards.
If a payment fails but money has been deducted from your account, the amount will generally be handled according to the payment provider's settlement/refund process.
9. DeliveryDelivery times shown on the platform are estimates and may be affected by:
Restaurant preparation time
Traffic and weather
Customer availability
Delivery partner availability
Location and distance
Technical or operational issues
Events outside reasonable control
Customers must provide a correct delivery address and remain reasonably available to receive the order.
Zovi Food may not be responsible for delays caused by incorrect customer information or circumstances outside its reasonable control.
10. CancellationCancellation options may depend on the order status.
Once a restaurant has started preparing an order, cancellation may not be possible or may be subject to applicable cancellation charges.
If cancellation is permitted, any eligible refund will be processed according to the applicable refund policy.
11. Refunds and ComplaintsIf you receive an incorrect, damaged, missing or materially different order, you should contact Zovi Food customer support as soon as reasonably possible.
We may request photographs, order information or other reasonable evidence to investigate the complaint.
Refunds, credits, replacements or other remedies will be determined based on the circumstances of the case and applicable law.
12. Restaurant ResponsibilitiesRestaurants and food businesses listed on Zovi Food are responsible for:
Preparing food safely and hygienically.
Maintaining required food licenses/registrations.
Providing accurate product information.
Using appropriate packaging.
Providing food that matches the customer's confirmed order.
Complying with applicable food-safety, labeling and other legal requirements.
FSSAI guidance for e-commerce food businesses also emphasizes valid seller FSSAI licensing/registration and appropriate food-safety practices.
13. Food SafetyZovi Food expects all participating food businesses and delivery operations to follow applicable food-safety requirements.
Where applicable, food businesses must provide accurate information and comply with applicable FSSAI requirements.
Zovi Food may suspend or remove listings where it reasonably believes that a food business does not meet applicable platform or legal requirements.
14. Prohibited ActivitiesYou must not:
Use Zovi Food for fraudulent transactions.
Place fake or intentionally misleading orders.
Create multiple accounts for abuse of offers.
Attempt to manipulate prices, ratings or reviews.
Use automated systems to misuse the platform.
Attempt unauthorized access to Zovi Food systems.
Upload unlawful, harmful or misleading content.
Use the platform for any activity prohibited by applicable law.
Zovi Food may provide promotional offers, discounts, coupons or referral programs.
Each promotion may have separate eligibility requirements, validity periods and conditions.
Zovi Food may cancel or restrict promotional benefits in cases of suspected misuse, fraud or violation of promotional terms.
16. Reviews and User ContentUsers may be allowed to submit reviews, ratings, photographs or other content.
You agree that your content must not:
Be false or misleading.
Contain unlawful or abusive material.
Infringe another person's intellectual property or privacy rights.
Contain spam or malicious code.
Zovi Food may remove content that violates these Terms or applicable law.
17. Intellectual PropertyThe Zovi Food name, logo, website design, software, graphics, text, trademarks and other platform content are owned by or licensed to Zovi Food unless otherwise stated.
You may not copy, reproduce, modify, distribute, sell or commercially exploit Zovi Food's intellectual property without prior written permission.
Restaurant names, logos, photographs and trademarks remain the property of their respective owners.
18. Third-Party ServicesZovi Food may use third-party services such as:
Payment gateways
Maps and location services
SMS/email providers
Delivery/logistics services
Analytics and technology providers
Third-party services may have their own terms and privacy policies.
19. Platform AvailabilityWe aim to keep Zovi Food available and functional, but we do not guarantee uninterrupted or error-free operation.
The platform may occasionally be unavailable because of maintenance, technical problems, security incidents or circumstances beyond our reasonable control.
20. Limitation of LiabilityTo the extent permitted by applicable law, Zovi Food will not be responsible for indirect or consequential losses arising from the use of the platform.
Zovi Food's responsibility may be limited to the extent permitted by applicable law and the circumstances of the particular transaction.
Nothing in these Terms is intended to exclude or restrict any consumer rights that cannot legally be excluded.
21. IndemnificationTo the extent permitted by law, you agree to indemnify and hold Zovi Food, its affiliates, employees and service providers harmless from claims, losses or expenses arising from:
Your violation of these Terms.
Fraudulent or unlawful use of the platform.
Your misuse of the platform.
Your violation of another person's rights.
Your use of Zovi Food is also subject to our Privacy Policy, which explains how we collect, use, store and protect personal information.
23. Changes to These TermsZovi Food may update these Terms from time to time.
Updated Terms will be published on this page with the revised "Last Updated" date.
Your continued use of Zovi Food after changes are published constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
24. Governing Law and JurisdictionThese Terms shall be governed by the applicable laws of India.
Any dispute shall be subject to the jurisdiction of the competent courts/authorities having jurisdiction over the matter, subject to applicable consumer-protection and other mandatory legal rights.
